1.1. The Three Community is a site operated by Three Ireland Services (Hutchison) Limited (“Three”) having its registered office and principle place of business at 28-29 Sir John Rogerson's Quay, Dublin 2.
1.2. Three provides the Three Community as a service to its customers only to help them exchange information and comment on Three services.
1.3. These terms and conditions are in addition to the general terms of use of wireless services and the rules of use set out in the Three Community Guidelines
1.4. By registering to use and contribute comments, questions, suggestions, ideas, answers, images and other material (“Content”) to any section of the Three Community you agree to be bound by these terms and conditions, the General Terms, the Three Community Guidelines, the Acceptable Use Policy and Privacy Policy and such other terms and conditions and policies as Three in its absolute discretion may have in place from time to time.
2.1. The Three Community is restricted to persons aged 13 years or over. By accepting these terms and conditions you confirm that you are aged 13 years or over. Three reserves the right at any time to verify the eligibility of participants in the Three Community.
3.1. You must not submit any Content to the Three Community that does not comply with these terms and conditions and/or the General Terms and/or the Three Community Guidelines.
3.2. In addition, you must not submit to the Three Community any Content which is deemed by Three (in its sole discretion) to be:-
3.2.1. in breach of any law or encourage a contravention of any law;
3.2.2. racist, sexist or homophobic;
3.2.3. pornographic, obscene, profane, vulgar, or contains swearing (including words which use * or any other symbol instead of a letter contained in a word);
3.2.4. defamatory of any person, entity or organisation whether directly or by implication;
3.2.5. abusive, threatening or otherwise likely to be harmful to those persons that use or are likely to use the Three Community;
3.2.6. in breach of the technical requirements of the Three Community;
3.2.7. otherwise offensive;
3.2.8. infringing of the rights (including but not limited to the intellectual property rights) of any person;
3.2.9. relating to the conduct of a business;
3.2.10. advertising, or soliciting business whether directly or indirectly;
3.2.11. impersonating, or attempting to impersonate another person, whether or not that person is a member of the Three Community;
3.2.12. infringing the privacy of an individual or company, including (but not limited to) posting location and/or contact details of another person;
3.2.13. encouraging, promoting or facilitating or in any way whatsoever relating to the illegal use of software.
3.2.14. encouraging, promoting or facilitating or in any way whatsoever relating to the illegal breach of these terms and conditions.
4.1. The Three Community is moderated and to enable moderation all Content must be in English only.
4.2. Three may review the Content submitted by you to the Three Community for suitability and for compliance with these terms and conditions and the General Terms and the Three Community Guidelines whether prior to or after the Content has been posted on the Three Community.
4.3. Three expressly reserves in its absolute and sole discretion the right to reject or accept Content at any time and for any reason. Further, Three may at any time and for any reason whatsoever and without notice or liability to you:
4.3.1. remove Content from the Three Community whether permanently or temporarily;
4.3.2. destroy any Content; and
4.3.3. terminate your access to the Three Community whether permanently or temporarily.
4.4. Before posting Content which contains an image of another person(s); an image of property owned by another person; and/ or reference to another person sufficient to identify them (either alone, or in combination with any other Content), you must obtain that other person's consent prior to posting the Content on the Three Community. Three reserves the right at any time to request any such evidence of consent as it sees fit and, without prejudice to clause 4.3 above, to withhold posting of Content until satisfactory evidence of consent to posting is forthcoming.
4.5. Three reserves the right to report to the relevant authorities any Content which it believes to be illegal.
5.1. Three does not claim ownership of any Content that you may submit or make available via the Three Community. You shall continue to own all rights in such Content and have the right to use such Content in any way that you choose.
5.2. By submitting to or making available any Content on the Three Community, you grant Three a perpetual, royalty-free, irrevocable, non-exclusive, sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, make available to the public (on the Three Community or elsewhere), and exercise all copyright and publicity rights with respect to the Content worldwide and/or to incorporate your Content in other works in any media now known or later developed for the full term of any rights that may exist in the Content as Three may require.
5.3. By submitting or making available any Content to the Three Community, you hereby waive all moral rights in that Content.
5.4. Three may at any time without notice to the you, grant the same or other rights in respect of your Content to third parties without payment to you and to sell, distribute or otherwise publish your Content outside of the Three Community.
6.1. "Ask the Expert" is an online message board which forms part of the Three Community on which Community members can post questions to valued members of the Three Community who have been selected to act by Three as Experts. Those Experts will then post responses to those questions asked by members.
6.2. You must be a registered member of the Three Community to ask a question to an Expert. You can ask a question to an Expert by going to Ask the Expert and following the instructions on the webpage.
6.3. The "Ask the Expert" message board is not moderated by Three. Three reserves the right to promptly remove or disable access to any Content on the "Ask the Expert" message board at any time and for any reason, without notice and without liability to you.
6.4. All Content posted by Experts on the "Ask the Expert" message board is provided solely as suggestions and is not intended to be relied upon. All Content posted by Experts is provided "as is" and without any warranties (express or implied), representations, conditions or guarantees of any kind.
6.5. Three is not liable or responsible in any way for any action taken by you or any member or user of the Three Community or any other person as a result of having read or been told about any Content posted by Experts. Three disclaims, to the fullest extent permitted by law, all liability arising from any action taken in reliance on such Content by you or any member or user of the Three Community or by any other person.
6.6. Three selects Three Community members to act as Experts at its sole discretion. You will be sent an email from Three inviting you to become an Expert.
6.7. By agreeing to become an Expert, you agree:
6.7.1. to adhere to these terms and conditions, the Three Community Guidelines, the Acceptable Use Policy and Privacy Policy
6.7.2. not to post any Content which may reduce or diminish the reputation of Three, Three’s brands and trademarks, or Three’s products and/or services;
6.7.3. not to represent yourself as having any authority from Three to act on behalf of Three or to bind Three in any way; and
6.8. All Content posted by Experts must:
6.8.1. comply with the Content standards set out at clause 3 above.
6.8.2. be accurate;
6.8.3. be honest and truthful;
6.8.4. be relevant;
6.8.5. be clear;
6.8.6. be original (this means that you cannot copy or re-use content from other websites or other material, unless you have express authority to do so);
6.8.7. not contain confidential and/or proprietary information; and
6.8.8. be solely their own personal opinions and do not represent opinions of Three. 6.9. Three will not pay or compensate you for being an Expert.
6.10. Experts will be invited to join as Experts by Three and all Content posted by Experts will be deemed Content for the purpose of these terms and conditions and will be moderated in accordance with clause 4 above
7.1. If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
8.1. Information which you provide to Three as part of the Three Community (including the Ask the Expert Feature and Three Ideas) and other information which you may supply to Three is subject to the Privacy Policy.
8.2. The current version of the Privacy Policy shall be deemed incorporated into these terms and conditions.
9.1. These terms and conditions shall be governed by and construed in accordance with Irish Law. Both you and Three hereby submit to the exclusive jurisdiction of the Irish courts.
9.2. Three reserves the right to review and revise its terms and conditions from time to time without giving you prior notice and by using the Three Community subsequent to any revision of our terms and conditions, you hereby agree to be bound by such changes.
